Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Scene platform, including our website at https://joinscene.app, our mobile application, and all related services (collectively, the “Service”) operated by Scene Inc. (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use the Service. By registering, you represent and warrant that you are 18 or older and legally capable of entering a binding agreement in your jurisdiction. We use third-party identity verification (Stripe Identity) to confirm age and identity. If we discover you are under 18, your account will be permanently terminated immediately.

The Service is intended for adults seeking social discovery and connections. It contains explicit adult content and mature themes. Use of the Service is void where prohibited by law.

2. Your Account

Registration and accuracy

You must provide accurate, current, and complete information during registration and keep your profile up to date. You may not impersonate any person or entity or misrepresent your identity, age, or affiliation with any person or organization.

Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@joinscene.app if you suspect unauthorized access. We are not liable for losses resulting from unauthorized account use.

One account per person

You may maintain only one account. Creating duplicate or replacement accounts following a suspension or ban is prohibited and will result in permanent removal.

3. Identity Verification

Full access to the Service, including sending messages, requires completing identity verification through Stripe Identity. Verification requires a government-issued ID and a selfie. We do not store your ID documents. Verification is used solely to confirm you are a real adult. Passing verification does not guarantee another user's behaviour or intentions.

Providing false or altered documents for verification is a serious violation of these Terms and may be illegal. Such conduct will result in immediate permanent termination and may be reported to relevant authorities.

4. Acceptable Use

You agree not to

• Post content that is illegal, fraudulent, defamatory, or that infringes any third-party rights.
• Harass, threaten, stalk, bully, or intimidate any person.
• Post, share, or solicit content involving minors in any sexual or exploitative context — doing so will result in immediate termination and reporting to law enforcement and the National Center for Missing & Exploited Children (NCMEC).
• Share another person's private or intimate images without their explicit consent (“non-consensual intimate imagery”).
• Solicit money, gifts, or financial information from other users; engage in escort, sex-work solicitation, or commercial transactions through the Service.
• Use the Service for spam, phishing, or distributing malware.
• Scrape, crawl, or use automated means to access or collect data from the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service.
• Circumvent or attempt to bypass any security or access-control feature.
• Impersonate another user, celebrity, or any other person.
• Use the Service for any commercial purpose without our express written consent.

5. Content You Post

Your responsibility

You are solely responsible for all content you upload, post, or transmit through the Service (“User Content”), including photos, messages, profile information, and audio. You represent that you own or have the rights to post such content and that it does not violate any law or third-party rights.

License to us

By posting User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, and display that content solely to operate and improve the Service. This license ends when you delete the content or your account, subject to reasonable backup and legal-hold periods.

Adult content

The Service permits adult content between verified users who have consented. Explicit content must not depict anyone under 18, non-consensual acts, or real violence. You must have the consent of all identifiable persons depicted in explicit content before posting it. Content depicting, describing, or glorifying sexual violence or assault is strictly prohibited.

Private albums

You may share private photo albums with specific users. You grant those recipients a limited, personal, non-transferable right to view that content. Recipients may not download, screenshot, or redistribute private album content without your consent. Sharing another person's private album content is a violation of these Terms.

6. Safety

Your safety is important to us, but we cannot guarantee it. When meeting anyone in person, exercise caution: meet in public places first, tell someone where you are going, and trust your instincts. We are not responsible for the offline conduct of users.

To report abuse, safety concerns, or illegal content, contact us at support@joinscene.app. We take all reports seriously and will act promptly on credible safety concerns, including cooperating with law enforcement when required by law.

7. Intellectual Property

The Service, including its design, code, trademarks, and content produced by us, is owned by Scene Inc. and protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without our prior written permission.

8. Privacy

Our Privacy Policy describes how we collect, use, and protect your information. By using the Service, you consent to our data practices as described therein. The Privacy Policy is incorporated into these Terms by reference.

9. Location Data

The Service uses your device's location to show you nearby profiles and approximate your distance from others. We display distance ranges only — we do not show your precise coordinates to other users. You can disable location access through your device settings, but doing so will limit discovery features. We handle location data as described in our Privacy Policy.

10. Termination

By you

You may delete your account at any time through the app. Deletion removes your profile from discovery. Residual copies may be retained in backups for a limited period as described in our Privacy Policy.

By us

We may suspend or permanently terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, pose a safety risk, or for any other reason at our sole discretion. We are not obligated to provide reasons. Banned users may not create new accounts.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED ACCESS. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

We make no representations about other users' identity, character, or intentions. Interactions with other users — online and offline — are at your own risk.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCENE INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED POUNDS STERLING (GBP £100).

SOME JURISDICTIONS DO NOT ALLOW EXCLUSION OF CERTAIN WARRANTIES OR LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

13. Indemnification

You agree to defend, indemnify, and hold harmless Scene Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be resolved exclusively in the courts of London, England, and you consent to personal jurisdiction there.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will post the updated Terms and update the date at the top of this page. For significant changes, we will notify you via email or in-app notice. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.

16. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Scene Inc. regarding the Service and supersede all prior agreements.
